Content Creator Agreement

1. Parties and acceptance

This Content Creator Agreement (“Agreement”) is between you (“Creator,” “you”) and Bonderly, trading as Fanderly (“Fanderly,” “we,” “us”), for creator features on fanderly.com and related apps (the “Service”), including Creator Tools, publishing, subscriptions, tips, paid posts, messaging, analytics, Fanderly Plus engagement shares, and payouts.

You accept this Agreement when you submit a creator application, check the creator agreement box, complete identity verification for publishing, or use creator features after approval. If you do not agree, do not apply or use creator tools.

This Agreement supplements our Terms of Service. If there is a conflict about creator-specific topics (earnings, payouts, character ownership, verification for publishing), this Agreement controls. For everything else, the Terms control.

2. Eligibility

To become or remain a Creator you must:

Have a Fanderly account and be signed in before you apply.
Be at least 18 years old and legally able to enter this Agreement.
Own or have all rights needed to operate the AI character and content you submit.
Provide accurate account, payout, and verification information.
Comply with this Agreement, the Terms of Service, the Privacy Policy, and applicable law.

You may not apply or operate a creator account if you are under 18, if doing so is unlawful where you live, or if Fanderly has previously banned you for serious violations (unless we expressly reinstate you).

3. Application and approval

Creator access requires an approved application (or an admin promotion). Applications are reviewed at Fanderly’s discretion. Reviews usually take about 7 days; timing is not guaranteed.

We may approve, refuse, delay, condition, or withdraw approval for any lawful reason, including incomplete information, rights concerns, safety risk, or prior abuse. Approval does not guarantee featuring, earnings, or continued access.

4. Identity and age verification

Before you may publish sexually explicit content, you must complete age and identity verification through our provider Didit. We do not approve sexually explicit publishing without a successful verification on file.

You authorize Fanderly and Didit to process verification data as described in our Privacy Policy and our 18 U.S.C. § 2257 Compliance Statement. You must keep verification current if we ask you to re-verify. Failure or revocation of verification may suspend publishing or your creator account.

5. Independent creator

You are an independent creator, not an employee, agent, partner, or joint venturer of Fanderly. Nothing in this Agreement creates employment, exclusivity, or a guarantee of income.

You decide what to publish (within our rules), set your own packages and prices as the product allows, and are responsible for your own equipment, tools, taxes, and business costs unless we expressly provide otherwise.

6. Character ownership and intellectual property

You retain ownership of the AI character concept, prompts, and original content you create and upload, subject to licenses you grant Fanderly and to third-party rights (for example model providers or stock assets you use).

You represent that you have all rights needed to operate the character and to publish images, video, audio, and text you upload or generate for the Service. You will not:

Impersonate a real person without the rights and permissions required by law and by our policies.
Present a character as a real minor, or depict or sexualize anyone under 18 — including AI-generated material.
Upload content that infringes copyright, trademark, privacy, publicity, or other rights.

If we receive a valid rights complaint, we may remove content, restrict features, or suspend the account while we review.

7. License to Fanderly

You grant Fanderly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publish, display, distribute, and promote your creator profile, handle, avatar, public posts, and other content you make available on the Service, solely to operate, improve, secure, and market the Service (for example feed, Explore, For You, stories, search, recommendations, and promotional materials showing the platform).

This license ends when the relevant content is deleted from the Service, except for reasonable residual copies in backups and copies that fans already lawfully received (for example a subscription period or paid unlock already delivered).

8. Content standards

You are responsible for content you publish, send, sell, or configure (including AI persona settings, prompts, and vault media that shape replies). Adult sexual content between consenting adults 18+ may be allowed where the product permits it and you have completed required verification. You agree not to upload, sell, generate, or request content that:

Involves anyone under 18, or depicts or sexualizes minors — including fictional, cartoon, simulated, or AI-generated depictions, and including subjects in diapers or age-play presented as underage.
Is a deepfake, or uses the image or strong likeness of a real person without that person’s documented consent.
Is non-consensual intimate imagery or non-consensual sexual scenarios, including sleeping, unconscious, drugged, or forced scenarios.
Depicts incest; watersports; snuff or fantasy snuff; abduction or eroticized violence; bestiality or animal cruelty; sexual activity under drugs, alcohol, or hypnosis; prostitution or escorting scenarios; or polygamy.
Assists illegal activity, provides professional medical/legal/gambling advice as if from a licensed expert, or constitutes hate speech.
Infringes others’ rights, or violates our Terms of Service or this Agreement.
Is doxxing or severe harassment.

We may remove content, refuse AI prompts, limit distribution, require edits, or suspend accounts that violate these standards. Automated filters and human review may be used. Fanderly does not pre-screen all content and is not the author of your posts.

9. Earnings and platform fee

Creator income on Fanderly comes from two kinds of sources:

Direct fan purchases — subscriptions to your packages, tips, and paid-post (PPV) unlocks.
Fanderly Plus engagement pool — a share of paid site-wide Fanderly Plus membership revenue, attributed by Plus fan engagement with your character (see section 10).

For direct fan purchases, creators keep 80% of eligible amounts and Fanderly’s platform fee is the remaining 20%, deducted before payout. Gross and net amounts appear in Creator Tools → Insights. You cash out from Creator Tools → Payouts.

We may change the fee structure with notice by updating this Agreement or the product. Material fee changes will be reflected in the “Last updated” date and, where practical, notified in Creator Tools or by email. Continued use of creator features after a change constitutes acceptance.

Earnings are estimates until payments clear, refunds or chargebacks are resolved, and any holds we apply for fraud, compliance, or error correction are released. Fanderly does not guarantee any level of earnings.

10. Fanderly Plus creator pool

Fanderly Plus is Fanderly’s site-wide AI membership for fans (separate from a subscription to your character). Paid Plus revenue is split between platform costs (including AI inference and infrastructure), a reserve for refunds and chargebacks, and a monthly creator engagement pool.

The creator pool is a configured share of paid Plus membership revenue for the period (for example around one-third of Plus MRR; the exact percentage may be adjusted in the product and is shown when pool shares are settled). Unpaid free trials do not fund the pool unless we expressly run a separate promotional pool.

Each settlement period, the pool is distributed among eligible creators in proportion to Plus-attributed engagement with their characters, including (as tracked in the product):

AI chat messages from paid Plus fans,
voice interactions, and
photo / custom-picture interactions.

Engagement may be weighted (for example messages vs voice vs photos), capped per fan→creator pair, and subject to a minimum activity floor so inactive accounts do not receive a share. Self-traffic, bots, and similar abuse may be excluded. Only verified / approved creators are eligible.

Your pool allocation appears in Creator Tools → Insights as a Fanderly Plus share (or similar label) and is credited as a net creator amount — it is not reduced again by the 80/20 split that applies to subscriptions, tips, and PPV. After credit, it forms part of your available balance and can be withdrawn under section 11 like other earnings.

Plus pool shares may be held briefly for refund and chargeback risk. We may recalculate, withhold, or claw back pool credits for fraud, error, or policy abuse. Pool mechanics (weights, caps, pool percentage, and settlement cadence) may change with notice via this Agreement or the product.

11. Payouts

Available balances appear in Creator Tools → Payouts and include net amounts from subscriptions, tips, PPV, and settled Fanderly Plus shares. You may request a payout when you have an available balance and have provided valid payout details. Production payouts are processed weekly. Processed payouts are final once sent; contact support promptly if an amount looks wrong before requesting another transfer.

We may delay, withhold, offset, or reverse amounts to the extent needed for chargebacks, refunds we are required to honor, suspected fraud, legal process, tax compliance, or clear accounting errors. Minimum payout thresholds or method limits may apply as shown in Creator Tools.

You are responsible for the accuracy of your payout destination. Transfers sent to details you provided are your responsibility once correctly processed by our payment partners.

12. Taxes

You are solely responsible for determining and paying taxes that apply to your creator income, and for any registrations or filings required in your jurisdiction. Fanderly may collect tax information, withhold amounts, or issue statements where required by law. Platform fees and payouts may be shown exclusive of taxes unless stated otherwise.

13. AI features and disclosures

Fanderly is an AI creator platform. Characters, images, video, and chat replies may be wholly or partly computer-generated. AI output can be inaccurate, inconsistent, or offensive. You are responsible for persona settings and for content you choose to publish.

Where fans use AI chat with your character — including fans on Fanderly Plus — messages may be sent to third-party model providers to generate replies, subject to our Privacy Policy and product limits. Plus-attributed chat, voice, and photo activity may be used to calculate your Fanderly Plus pool share under section 10. You will not configure or promote your character in a way that claims it is a real underage person, requests deepfakes of real people, or otherwise violates section 8. Platform filters may refuse prohibited prompts even if your persona would otherwise allow them.

14. Promotion and ranking

Fanderly may feature hashtags, place your public content in Explore or For You, and use your handle, avatar, and public posts to operate and promote the Service. Ranking and discovery are discretionary and may change. Featured placement is not owed and may be removed at any time.

15. Refunds and chargebacks

Fan refunds and cancellations are described in our Refunds & Cancellation Policy. Fan wallet refunds do not automatically reverse a creator payout that has already been processed; those cases are reviewed individually and may result in balance adjustments or offsets against future earnings, including Fanderly Plus pool credits where appropriate.

Excessive chargebacks, fraud, or manipulation of subscriptions, tips, paid posts, or Plus engagement attribution may lead to holds, suspension, or termination.

16. Conduct

You will not abuse the Service, attempt to circumvent fees or verification, scrape or attack the platform, buy or sell accounts, or use creator tools to harass fans or other creators. You will cooperate reasonably with compliance, safety, and rights reviews.

17. Representations and warranties

You represent and warrant that: (a) the information you provide is accurate; (b) you have the rights described in section 6; (c) your content and use of the Service will comply with this Agreement and law; and (d) you will not use the Service to engage in illegal activity.

The Service is provided “as is.” We do not warrant uninterrupted availability, any particular earnings, or that AI output will meet your expectations.

18. Indemnity

You will defend and indemnify Fanderly and its officers, directors, and personnel against claims, losses, and reasonable costs arising from your content, your character, your breach of this Agreement, or your violation of law or third-party rights, to the fullest extent permitted by law.

19. Suspension and end of creator status

You may stop creating and may delete your account in Settings, subject to records we must keep for law, tax, or fraud review. We may suspend or end creator access or close your account if you break this Agreement or the Terms, if required by law, or if we discontinue creator features or the Service.

On termination for cause, we may withhold unpaid balances to the extent needed to cover chargebacks, fees, or harm. On orderly exit or Service wind-down, we will use reasonable efforts to pay undisputed available balances, subject to our Refunds policy and legal constraints.

Sections that by nature should survive (including licenses for residual copies, taxes, indemnity, liability limits in the Terms, and governing law) survive termination.

20. Relationship to other policies

This Agreement works together with:

21. Changes and governing law

We may update this Agreement. The “Last updated” date will change. Continued use of creator features after an update constitutes acceptance. If a change is material, we will try to notify you in Creator Tools or by email.

This Agreement is governed by the laws of the Netherlands, without regard to conflict-of-law rules. Courts in the Netherlands have exclusive jurisdiction, except that you may have mandatory rights in your country of residence that we will respect.

If a provision is unenforceable, the rest remains in effect. This Agreement and the documents it incorporates are the entire agreement between you and Fanderly regarding creator participation, and supersede prior creator-specific understandings on the same subject.
