1. The agreement
These Terms of Service (“Terms”) are a contract between you and Fanderly for use of fanderly.com, related apps, and features such as the feed, wallet, subscriptions, messages, AI chat, Studio, and Help Center (together, the “Service”).
Our Privacy Policy describes how we handle personal information. Help articles at Help Center explain how features work; if a help article conflicts with these Terms, the Terms control.
2. Eligibility
You must be at least 18 years old to register, apply as a creator, or use Fanderly. By joining you confirm that you are 18 or older and that you have the legal capacity to enter this contract.
The Service may include adult-oriented or synthetic media. You agree that you will not use Fanderly if that is not lawful for you, and that you will not expose the Service to anyone under 18.
3. Accounts
You can sign up with email and password or with Google, X, or Apple. You are responsible for your login credentials and for activity on your account. Keep your email accurate so we can reach you about billing and safety.
You may update your display name in Settings. Roles on Fanderly are fan, creator, and admin. New sign-ups start as fans. Creator access requires an approved application or an admin promotion.
You may delete your account in Settings. Deletion is permanent and removes wallet history, subscriptions, and saved data from the live Service, subject to records we must keep for law, tax, or fraud review.
4. The service
Fanderly is a platform for exclusive content from AI creators. Fans may follow creators, subscribe, unlock paid posts, tip, bookmark, comment, and send messages. Creators may publish posts (including locked media), set packages, chat with fans, view analytics, and request payouts.
We may change, pause, or discontinue features. We do not guarantee that any particular creator, post, or AI reply will remain available.
5. Wallet and billing
You may add funds to your Fanderly wallet with a saved card. Wallet balance is charged first for subscriptions, tips, and paid posts. If the wallet is short, your default card is charged for the remainder. Unused wallet balance does not expire.
We store payment-method brand, last four digits, and expiry only. You authorize Fanderly to charge your wallet and default card for amounts you confirm in the product, including automatic subscription renewals until you cancel.
Prices are shown in the product (typically USD). You are responsible for any taxes that apply to your purchases, except taxes Fanderly is required to collect.
6. Subscriptions, tips, and paid posts
Creators set their own subscription packages (name, price, and length). Subscriptions renew automatically at the plan price. Cancel anytime before the renewal date and you keep access until that date; there is no extra charge for the unused remainder of a period, and we do not prorate after a period has started.
Active subscribers typically unlock that creator’s exclusive posts, receive 20% off that creator’s paid posts, and get priority in direct messages, as shown in the product at the time of purchase.
Tips are voluntary payments to a creator and are final once sent. Paid posts unlock specific locked media. If a paid post cannot be delivered, the charge is returned to your wallet.
7. Refunds
- Unused wallet funds can be refunded to the original payment method. Request a refund from Contact using the email on your account. Approved refunds typically take 5–10 business days.
- Subscriptions are not prorated after the billing period starts.
- Tips are non-refundable once sent.
- Paid posts are refunded to your wallet if the content cannot be delivered.
- Messaging credits are returned if the creator does not reply within 24 hours.
Chargebacks on valid purchases may lead to account review, suspension, or termination. Fan wallet refunds do not automatically reverse a creator payout that has already been processed; those cases are reviewed individually.
8. Creator terms
To become a creator you must be 18+, own the AI character you submit, and complete an application. Reviews usually take about 7 days. Approval is at Fanderly’s discretion and may be withdrawn.
Creators keep 80% of eligible earnings from subscriptions, tips, and paid-post sales. Fanderly’s platform fee is the remainder and is deducted before payout. Earnings appear in Studio. You may request a payout when you have an available balance. Production payouts are processed weekly. Processed payouts are final; contact support if an amount looks wrong before requesting another transfer.
You represent that you have all rights needed to operate the character and to publish the content you upload, including AI-generated images, video, and text. You will not impersonate a real person without the rights to do so, and you will not present a character as a real minor.
Fanderly may feature hashtags, place your public content in Explore or For You, and use your handle, avatar, and public posts to operate and promote the Service.
9. Content rules
You are responsible for the content you post, comment, or send. You agree not to upload or request content that:
- Involves anyone under 18, or depicts a character as under 18, including AI-generated material.
- Infringes someone else’s copyright, trademark, or publicity rights, including unauthorized deepfakes of real people.
- Is illegal, or that promotes scams, malware, or violent crime.
- Harasses, doxxes, or impersonates others, or circumvents blocks, bans, or paywalls.
- Attempts to reverse-engineer, scrape, or disrupt the Service.
Users may block accounts and report content. We may remove content, restrict features, or terminate accounts that violate these Terms. Fanderly does not pre-screen all content and is not the author of creator posts or fan comments.
10. AI features and messaging
Some creators use Fanderly’s AI chat so fans can talk with a character. Replies are generated by software and may be inaccurate, offensive, or inconsistent with the character. AI output is not professional, medical, legal, or financial advice, and it is not a real person.
Messages you send to AI chat may be transmitted to third-party model providers to generate a reply. Daily usage limits may apply. Direct messages between fans and creators are private to the thread except as needed to operate, secure, or legally process the Service.
11. Your license to Fanderly
You keep ownership of content you create. You grant Fanderly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publish, and display that content solely to operate, improve, and promote the Service (for example showing posts in the feed, stories, search, and creator profiles).
This license ends when your content is deleted from the Service, except for reasonable residual copies in backups and content that other users already lawfully received (for example a purchased unlock during a paid period).
12. Fanderly’s rights
Fanderly, the bolt mark, and the product design are owned by Fanderly. You may not copy the platform, our trademarks, or our non-user content except as allowed by law. Feedback you send may be used without obligation to you.
13. Suspension and deletion
You may stop using Fanderly and delete your account at any time. We may suspend or close an account if you break these Terms, if we are required to by law, or if we discontinue the Service. We may also refuse or reverse creator applications.
If we terminate for cause, unused wallet funds may be withheld to the extent needed to cover chargebacks, fees, or harm. If we discontinue the Service, we will provide a reasonable way to request unused wallet refunds where technically and legally possible.
14. Disclaimers
The Service is provided “as is.” Content is created by users and by AI systems. We do not warrant that the Service will be uninterrupted, that content is accurate, or that a creator will post on any schedule. AI-generated characters, images, and chat are synthetic and may not represent real people or events.
15. Limitation of liability
To the fullest extent permitted by law, Fanderly is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising from your use of the Service or from creator or AI content.
Fanderly’s total liability for any claim relating to the Service is limited to the greater of (a) the amounts you paid to Fanderly in the 12 months before the claim or (b) €100. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.
16. Changes and governing law
We may update these Terms. The “Last updated” date will change, and continued use after an update constitutes acceptance. If a change is material, we will try to notify you in the product or by email.
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Courts in the Netherlands have exclusive jurisdiction, except that you may have mandatory consumer rights in your country of residence that we will respect.
If a provision is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and Fanderly for the Service.
